Consumer Credit and FCRA Rights Notice
GetKarr's Role
GetKarr operates as a marketing and lead generation platform that connects consumers interested in vehicle financing with participating third party dealerships and, where applicable, third party lenders or financing providers.
GetKarr is not a lender, creditor, dealership, or consumer reporting agency. GetKarr does not itself make credit decisions, approve or deny financing applications, determine interest rates, establish loan terms, or guarantee financing approval.
Any financing decision, credit inquiry, financing offer, interest rate, payment, loan term, or other financing terms are determined solely by the applicable participating dealership, lender, or financing provider.
A Summary of Consumer Rights Under the Fair Credit Reporting Act
The federal Fair Credit Reporting Act, commonly known as the FCRA, promotes the accuracy, fairness, and privacy of information maintained by consumer reporting agencies.
Consumer reporting agencies include nationwide credit bureaus and other agencies that collect and provide consumer information.
The following is a general summary of important consumer rights under the FCRA.
Your Right to Know if Information Was Used Against You
You generally have the right to be notified if information contained in a consumer report was used to take adverse action against you.
If a participating dealership, lender, or financing provider uses information from a consumer report to deny a credit application or take another action covered by applicable law, that entity may be required to provide you with an adverse action notice.
GetKarr does not make credit decisions or issue adverse action notices.
Your Right to Know What Is in Your Consumer File
You may have the right to request information maintained about you by a consumer reporting agency.
Depending on applicable law and your circumstances, you may be entitled to receive certain consumer report information at no cost.
Examples may include situations where:
- Information in your consumer report was used in connection with an adverse action.
- You are the victim of identity theft.
- Your consumer file contains information affected by fraud.
- You qualify for certain other rights provided under federal or state law.
Consumer reporting agencies may require appropriate identification before providing information.
Your Right to Dispute Inaccurate or Incomplete Information
If you believe information in your consumer report is inaccurate or incomplete, you may have the right to dispute that information with the applicable consumer reporting agency.
Consumer reporting agencies generally have obligations under applicable law to investigate qualifying disputes and correct or delete information that is determined to be inaccurate, incomplete, or unverifiable.
Your Right to Request Information About Your Credit
Consumers may be able to request information about their credit history or credit score from consumer reporting agencies or other authorized providers.
Availability and cost may vary depending on the service and applicable law.
GetKarr does not provide credit reports or credit scores.
Your Right to Limit Access to Your Consumer Information
Consumer reporting agencies may generally provide consumer report information only to persons or entities that have a legally permitted purpose to obtain that information.
Access to consumer reports is governed by applicable federal and state law.
Employment Related Consumer Reports
Consumer reporting agencies generally may not provide consumer report information to an employer or prospective employer for employment purposes without the disclosures and authorization required by applicable law.
GetKarr does not provide employment screening services.
Prescreened Credit and Insurance Offers
You may have the right to limit certain prescreened offers of credit or insurance that are based on information contained in your consumer report.
Information about available opt out rights may be obtained through the appropriate consumer reporting agencies or government consumer protection resources.
Security Freezes and Fraud Alerts
You may have the right to place a security freeze on your consumer report.
A security freeze can restrict a consumer reporting agency from releasing information in your consumer report without appropriate authorization, subject to exceptions provided by law.
You may also have the right to place a fraud alert on your consumer file.
A security freeze or fraud alert may delay or interfere with the processing of a future credit application because a lender or other authorized entity may be unable to access information necessary to evaluate the application.
For additional information about security freezes and fraud alerts, contact the applicable consumer reporting agency or consumer protection authority.
Your Right to Seek Remedies
Consumers may have the right to seek damages or other remedies where permitted by law if a consumer reporting agency, user of consumer reports, furnisher of information, or another entity violates applicable consumer reporting laws.
Additional Rights for Identity Theft Victims and Active Duty Servicemembers
Identity theft victims and active duty military personnel may have additional rights and protections under federal and state law.
Additional information may be available from consumer reporting agencies and government consumer protection authorities.
Credit Reports and Credit Inquiries
GetKarr does not itself make lending decisions or extend credit.
If you choose to proceed with a participating dealership, lender, or financing provider, that Partner may request additional information from you and may conduct a credit inquiry where legally permitted and after obtaining any required authorization.
A credit inquiry may affect your credit score depending on the type of inquiry conducted.
Before a formal credit application or credit inquiry is completed, the applicable dealership, lender, or financing provider is responsible for obtaining any required authorization and providing any disclosures required by applicable law.
GetKarr does not guarantee whether any inquiry performed by a participating Partner will be a soft inquiry or a hard inquiry.
Adverse Action Notices
GetKarr does not make credit decisions.
If a participating dealership, lender, or financing provider denies an application or takes another action that requires an adverse action notice under applicable law, that entity is responsible for providing any legally required notices and disclosures.
Where applicable, an adverse action notice may include information about the consumer reporting agency that supplied information used in making the decision and information about the consumer's rights.
